PLEASE READ THIS TRAVEL ADVISORY AGREEMENT AND TERMS OF USE ("AGREEMENT") CAREFULLY. THIS AGREEMENT CONTAINS A MANDATORY BINDING INDIVIDUAL ARBITRATION CLAUSE AND CLASS ACTION WAIVER THAT DIRECTLY AFFECTS YOUR LEGAL RIGHTS.
1. Intermediary Status & Nature of Services
OpenBound ("Agency," "we," "us," or "our"), organized and operating in the State of Oklahoma, functions strictly as an independent travel sales intermediary and booking facilitator. OpenBound is not a common carrier, hotelier, tour operator, cruise line, rental car company, or direct provider of travel accommodations ("Suppliers").
All airline tickets, cruise itineraries, lodging reservations, tour excursions, transfers, and travel arrangements coordinated by OpenBound are sold by us acting solely as an agent for third-party independent Suppliers. Each Supplier maintains its own separate, binding terms, conditions, carriage contracts, tariffs, cancellation schedules, and baggage rules. By utilizing OpenBound's services, you ("Client," "Traveler," "you") agree to be bound by the specific terms and policies of every Supplier fulfilling your booking.
2. Comprehensive Errors & Omissions (E&O) and Liability Waiver
To the maximum extent permitted by applicable federal and state law:
Supplier Performance & Insolvency: OpenBound assumes no liability, responsibility, or financial obligation for any acts, omissions, errors, warranties, breaches, negligence, gross negligence, financial distress, bankruptcy, liquidation, or intentional wrongdoing of any independent Supplier.
Pricing, Itinerary, and Typographical Errors: While OpenBound exercises reasonable diligence to ensure accuracy, the travel market experiences rapid inventory and rate fluctuations. OpenBound and its Suppliers reserve the right to correct any inadvertent clerical, pricing, or typographical errors at any time, even after a booking confirmation or invoice has been generated. In such instances, you will be offered the choice between proceeding with the corrected rate/itinerary or receiving a complete refund of amounts actually paid toward the disputed item.
Force Majeure: OpenBound shall not be deemed in breach of this Agreement, nor held liable for any loss, damage, expense, injury, delay, or cancellation resulting directly or indirectly from Acts of God, severe weather, hurricanes, earthquakes, epidemics, pandemics, government quarantine, health declarations, international border closures, civil unrest, war, acts of terrorism, strikes, airspace closures, mechanical breakdowns, or other occurrences beyond our reasonable control.
Limitation of Financial Recovery: In no event shall OpenBound, its officers, members, employees, or affiliates be liable for any indirect, punitive, special, incidental, or consequential damages. OpenBound’s aggregate liability arising out of or related to our services, whether sounding in contract, tort, negligence, strict liability, or breach of fiduciary duty, shall not exceed the total professional planning or service fees actually received and retained by OpenBound for the specific booking at issue.
3. Client Responsibility: Passports, Visas, and Health Requirements
Documentation Verification: Each traveler is exclusively responsible for researching, securing, and maintaining all mandatory international and domestic travel credentials, including passports valid for at least six (6) months beyond the scheduled return date, machine-readable documents, tourist/business visas, transit visas, and reciprocal entry permits.
REAL ID Compliance: Domestic travelers within the United States are solely responsible for ensuring their state-issued driver's license or secondary ID complies fully with the federal REAL ID Act.
Health and Entry Protocols: Travelers bear sole responsibility for verifying and complying with destination-specific entry criteria, including medical immunizations, health declarations, travel insurance mandates, and customs restrictions. OpenBound is not liable for denied boarding, visa rejections, deportations, or travel disruptions resulting from improper documentation.
4. Travel Insurance Waiver and Recommendation
OpenBound strongly advises every traveler to purchase comprehensive travel protection covering trip cancellation, trip interruption, medical emergencies, emergency medical evacuation, supplier default, and baggage loss. If you decline travel protection, you explicitly acknowledge that you assume full personal financial responsibility for any out-of-pocket costs, penalties, non-refundable deposits, or cancellation fees resulting from unforeseen emergencies.
5. Payments, Authorizations, and Chargeback Waiver
Payment Processing: All electronic credit and debit card transactions are handled through a secure, third-party Payment Card Industry Data Security Standard (PCI-DSS) compliant payment gateway. OpenBound does not store complete, unencrypted Primary Account Numbers (PAN) or Card Verification Values (CVV) on its agency web servers.
Chargeback Prohibition: By submitting booking authorizations, you expressly authorize OpenBound and designated Suppliers to charge your designated payment instrument. You covenant and agree that you will not initiate, file, or threaten unjustified credit card chargebacks or payment reversals for non-refundable travel charges, supplier bankruptcies, service dissatisfaction, schedule modifications, or Force Majeure disruptions. All monetary disputes must be handled exclusively according to the refund policies of the applicable Supplier and the Dispute Resolution process below.
6. Seller of Travel Disclosures
State Registrations: Where required by law, transactions are fulfilled directly in compliance with applicable state seller of travel statutes.
California & Florida Disclosures: OpenBound acts as an independent intermediary. For transactions involving California residents: This business is not currently a participant in the California Travel Consumer Restitution Fund (TCRC) unless specifically registered and disclosed on individual invoicing. For transactions involving Florida, Hawaii, or Washington residents: All client funds received are strictly transmitted to third-party travel Suppliers or maintained in accordance with applicable escrow, trust account, or host agency affiliation requirements.
7. Mandatory Dispute Resolution, Binding Arbitration, and Class Action Waiver
Informal Resolution: Prior to filing any formal legal claim, you and OpenBound agree to engage in good-faith negotiations to resolve the issue informally for at least thirty (30) days following written notice sent to hello@openboundtravel.com (or OpenBound's primary business address).
Binding Individual Arbitration: If the dispute remains unresolved, any controversy, claim, or dispute arising out of or relating to this Agreement, your use of our website, or services provided by OpenBound shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place exclusively in Tulsa County, Oklahoma, or virtually upon mutual agreement.
Class Action Waiver: YOU AND OPENBOUND AGREE THAT ALL CLAIMS AND DISPUTES MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, REPRESENTATIVE, OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR CANNOT CONSOLIDATE MULTIPLE PERSONS' CLAIMS.
Governing Law & Venue: This Agreement and any arbitration proceedings shall be governed strictly by the internal substantive laws of the State of Oklahoma, without regard to its conflict-of-laws principles.

OpenBound ("we," "us," or "our") respects your personal privacy. This Privacy Policy details our operational practices regarding the collection, handling, disclosure, and protection of information obtained through our website, mobile interfaces, and direct travel booking consultations.
1. Categories of Information We Collect
We collect personal information directly from you when you submit booking inquiries, request travel proposals, complete traveler profile sheets, or communicate with our travel advisors:

Sensitive Personal Information (Collected Only for Booking Execution): Government-issued identification, passport numbers, citizenship, country of issuance, expiration dates, Known Traveler Numbers (TSA PreCheck/Global Entry), redress numbers, and optional medical/dietary accommodation requests.
Financial Billing Information: Billing address and payment card tokenized information handled securely via our PCI-DSS compliant third-party gateway.
Automated Data & Cookies: IP addresses, operating system, browser type, referral URLs, pages viewed, and engagement timestamps collected via cookies and tracking pixels.
2. Purpose of Processing and Legal Bases
OpenBound utilizes your information exclusively to:
Conduct pre-travel research, design customized itineraries, and secure reservations with airlines, cruise lines, hotels, tour operators, and rail providers.
Coordinate and process payments via PCI-compliant infrastructure.
Transmit critical itinerary updates, flight alerts, border entry notifications, and schedule adjustments.
Comply with legal and national security mandates (such as the Transportation Security Administration Secure Flight Passenger Data program).
Optimize our website functionality and digital user experience.
3. Data Disclosure to Third Parties
Travel Suppliers: We transmit personal and sensitive traveler credentials (including passport and date-of-birth data) solely to the third-party cruise lines, airlines, accommodations, ground operators, and consolidators required to fulfill your reservation.
Service Providers: We engage trusted operational vendors, such as PCI-compliant payment gateways, enterprise CRM platforms, and secure itinerary software.
No Sale of Data: OpenBound does not sell, rent, monetize, or lease your personal data or sensitive credentials to any third party. We do not share your data with external brokers for cross-context behavioral marketing.
4. Cookies, Analytics, and Tracking Technologies
Our website deploys standard first-party and third-party cookies, tracking tags, and analytics tools to assess traffic flow, diagnose server bottlenecks, and enhance platform navigation. You can manage or disable cookies via your individual browser settings; however, disabling certain technical cookies may limit functional features of our online booking inquiry modules.
5. Children's Privacy (COPPA & State Statutes)
Our website and marketing channels are directed exclusively to adults aged 18 and older. We do not knowingly solicit, collect, or store personal information directly from children under the age of 13 (or under 16 where required by state law). When minor traveler details are collected for family vacation bookings, such information must be furnished solely and directly by the child's parent or legal guardian.

Depending on your state of residence, you may possess distinct statutory privacy rights under comprehensive state privacy frameworks (such as the California Consumer Privacy Act/CPRA, Texas Data Privacy and Security Act, and others):
Right to Know/Access: The right to request the specific categories and pieces of personal information we have collected about you.
Right to Correction: The right to rectify incomplete or inaccurate personal records.
Right to Deletion: The right to request deletion of your personal data, subject to statutory record-retention exceptions (e.g., historical accounting, active bookings, legal defenses).
Right to Non-Discrimination: OpenBound will never deny services, charge varying rates, or alter quality of service if you exercise statutory privacy privileges.

7. Data Security and Retention Standards
We maintain administrative, technical, and physical security safeguards to shield your sensitive documents and personal data from unauthorized access, destruction, or disclosure. Payment information is securely encrypted during transmission via SSL/TLS and routed directly to certified PCI-DSS payment gateways. We retain personal data only as long as reasonably necessary to carry out travel coordination, address post-travel billing reconciliation, and comply with state and federal business record-keeping laws.
